Auction Terms & Conditions

Disclaimer: Please know these policies are in place solely to protect us against fraud and to ensure a fair experience for all participants. At Paterson Auctioneers, we take great pride in providing excellent customer service and are committed to doing everything we can to ensure that every bidder and consignor is fully satisfied with their experience. Your trust and satisfaction are very important to us, and we are always happy to work with you to make the process smooth, fair, and enjoyable.

1. Currency

All bids, invoices, and payments are in United States Dollars (USD).

2. Condition of Lots

All items are sold strictly AS IS, without warranty or guarantee of any kind, express or implied.

To the best of Paterson Auctioneers' knowledge, all items are original issue unless otherwise stated. However, no guarantees or warranties regarding originality, authenticity, condition, or value are expressed or implied.

Bidders are solely responsible for satisfying themselves as to the condition and authenticity of any lot prior to bidding.

By placing a bid, the bidder affirms they have reviewed the photographs and descriptions, asked all desired questions, and accepts the item(s) as presented.

3. No Returns, No Refunds

All sales are final. No returns, exchanges, or refunds will be accepted for any reason.

4. Taxes

Shipments to addresses outside of Canada will not be charged sales tax (including shipments to the United States and all other international destinations).

Shipments to addresses within Canada are subject to applicable federal and provincial taxes (GST, QST, or HST, depending on the province).

5. Shipping

All shipping is conducted in-house by Paterson Auctioneers.

  • Items will be shipped via FedEx, Canada Post, or United States Postal Service (USPS), at Paterson Auctioneers' sole discretion unless otherwise agreed to in writing prior to shipment.
  • Shipping addresses: By default, all packages will be shipped to the delivery address registered on your account (or your LiveAuctioneers account, if you bid there). It is the bidder's responsibility to ensure the address on file is accurate.
  • Special shipping arrangements must be requested in writing and confirmed by Paterson Auctioneers prior to shipment.
  • We will make reasonable efforts to keep shipping costs low and to combine multiple lots for more economical shipping where possible.
  • Shipping timeline: Please allow 7–14 business days from receipt of cleared payment for shipment.
  • Insurance and tracking: All shipments will be insured and will include a tracking number unless expressly waived in writing by the buyer.
  • Risk of loss: Once items are handed over to the carrier, risk of loss or damage passes to the buyer. Paterson Auctioneers shall not be responsible for any loss, theft, or damage to packages or items during shipment, regardless of whether insurance is in place.
  • Claims: All shipping claims must be made directly with the carrier by the buyer.
  • International shipments: All shipments outside the USA and Canada are made entirely at the buyer's own risk.

6. Invoicing and Payment Terms

Winning bidders will receive an invoice via email from info@patersonauctioneers.com following the conclusion of the auction.

Accepted forms of payment:

  • Credit/Debit Card: Only for purchases with a combined final invoice total (hammer price + buyer's premium) of $1,000 USD or less.
  • Wire Transfer or Personal Check: Required for purchases exceeding $1,000 USD. Wire transfer instructions will be provided with the invoice if applicable.
  • We reserve the right to refuse or cancel payments that do not comply with these methods.
  • Payment deadline: Payment must be received within 10 calendar days of the invoice date.
  • Failure to complete payment within this time frame will result in the buyer being declared in default and may result in the opening of a dispute or legal action. Paterson Auctioneers reserves the right to cancel the sale and/or resell the lot(s) at its discretion. The original buyer will be held liable for any shortfall, expenses, and legal fees incurred.

7. Card on File & Automatic Payment

A verified credit card is required to bid and is securely held on file.

If no payment is received within 3 days of the lot closing, we reserve the right to automatically charge the winning bidder's card on file for the full invoice amount plus a 4% credit card processing fee.

This is a measure of last resort that we sincerely hope never to use. It exists solely to protect Paterson Auctioneers in the event that a winning bidder does not respond or refuses to pay.

8. Buyer's Premium

A 25% buyer's premium will be added to the hammer price of each lot and will be included in the final invoice.

9. No Chargebacks — Waiver of Chargeback Rights

By registering to bid and by placing a bid in this auction, the bidder expressly waives any right to initiate a chargeback against Paterson Auctioneers with respect to any payment made by credit card.

The bidder agrees that chargebacks shall not be initiated under any circumstances, and that their agreement to these Terms and Conditions constitutes conclusive, written evidence of such waiver.

In the event that a bidder initiates a chargeback in violation of these Terms, the bidder remains fully responsible for the full purchase amount, plus any applicable costs of collection, including attorney's fees, court costs, and administrative expenses incurred by Paterson Auctioneers.

Even if a chargeback is successful, the bidder shall remain personally liable for the full amount owed.

10. Binding Agreement

By registering for and/or placing bids in this auction, the bidder acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions of Payment. These terms are legally binding and enforceable under applicable law.

11. Governing Law and Jurisdiction

These Terms and Conditions, and any disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada, without regard to its conflict of laws principles.

The bidder agrees that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Fredericton, New Brunswick, Canada, and the bidder submits to the jurisdiction of said courts.
